KrifakTerms of Use
1. Acceptance of terms
By downloading, installing or using Krifak ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. You confirm your acceptance in the App the first time you use it.
These Terms form a legal agreement between you and Olmo Technologies (the "Company", "we", "us" or "our"), a sole-trader business based in Norway, which provides Krifak.
2. Service description
Krifak is a mobile application for PE teachers, sports teachers, coaches and activity leaders in schools and sport. It allows you to:
- Record attendance and assessment for each lesson, with goal attainment from low to high
- Keep an overview of each student's attendance, assessments, theory grades, test results and goals
- Draft term reports based on your own assessments and chosen criteria
- Make teams, run tournaments and use in-class tools such as a stopwatch, interval timer and student picker
- Run season-based learning with fixed teams, roles and matches, and make printable self-assessment forms
- Plan lessons and keep a class schedule and topic plan
All data entered in the App is stored on the user's own device. Krifak has no user accounts and no cloud storage.
3. Subscription and billing
Auto-renewing subscription
Most of the App, including recording lessons, requires an active subscription. Adding classes, students, the class schedule and assessment criteria can be done without one. The App shows what requires a subscription. The subscription is offered monthly or yearly at the price shown in the App at the time of purchase. By subscribing, you authorise Apple (App Store) or Google (Google Play) to charge your account on a recurring basis until you cancel.
No free trial
Krifak does not offer a free trial. The first payment is taken when you subscribe.
Access codes
We may provide access codes that unlock the App for a limited period, such as one school year. The period is stated when the code is given. Access codes are personal and may be withdrawn if they are shared or misused.
Cancellation
You may cancel your subscription at any time in your device's subscription settings in the App Store or Google Play. Cancellation takes effect at the end of the current billing period, and you keep access until that date.
Refunds
All purchases are processed by Apple or Google. Refund requests must be submitted to them directly, for Apple via reportaproblem.apple.com. We do not process refunds directly.
Price changes
We reserve the right to change subscription prices. Apple or Google will notify you of any price change in advance, and your subscription will continue at the new price unless you cancel.
4. Your responsibility for student data
The student data you enter in Krifak is yours to manage. When you use the App as part of your work, or as a coach or activity leader, you are responsible for:
- Making sure your school, school owner or the club you represent allows you to process student data in the App, and following its rules
- Entering only the data you need, and not writing health information or diagnoses in notes
- Keeping your device secure, for example by using the App's app lock
- Taking regular backups and keeping the backup password safe
Krifak is intended for recording attendance, lateness, lesson observations and assessment-related notes. Do not use it to record diagnoses, medical information, mental health conditions, medication use or other sensitive personal data.
Because the data exists only on your device, we cannot recover lost data or a forgotten backup password.
5. Acceptable use
You agree not to:
- Reverse engineer, decompile or attempt to extract the source code of the App
- Use the App for any unlawful purpose or in violation of any laws, including data protection laws
- Share, sell or publish access codes
- Use the App in any way that could damage, disable or impair it
6. Intellectual property
The App, including its design, text, graphics and code, is our property and is protected by Norwegian and international intellectual property law.
You are granted a limited, non-exclusive, non-transferable licence to use the App on your own devices.
You retain ownership of the content you create in the App, such as your own assessment criteria, notes and lesson plans. The built-in assessment criteria are provided as examples. You are responsible for checking that they match the criteria used at your school.
7. Assessment disclaimer
Krifak is a tool for documentation, planning and assessment support in physical education and sport. It is not an official system for grades, absence or student records, and it does not make assessments or set grades.
The provider has no access to stored student data. Each user and organisation is responsible for using the App in accordance with applicable rules and regulations.
Term report texts and summaries generated by the App are drafts based on the assessments and criteria you have entered. You are responsible for reviewing them and for all assessments and grades you give.
Krifak does not replace your school's official systems for grades or absence. Official records should be kept where your school requires.
8. Limitation of liability
To the maximum extent permitted by Norwegian law:
- The App is provided "as is" without warranties of any kind, express or implied.
- We do not warrant that the App will be uninterrupted or error-free.
- We shall not be liable for loss of data stored on your device, or for any indirect, incidental, special or consequential damages arising from your use of, or inability to use, the App.
- Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for your subscription in the three months preceding the claim.
Nothing in these Terms limits or excludes liability that cannot be excluded under applicable Norwegian consumer protection law.
9. Termination
We may suspend or terminate your access to the App if you breach these Terms, or if we decide to discontinue the App. Upon termination, your licence to use the App ends.
You may stop using the App at any time. Cancellation of your subscription must be done through Apple or Google as described in Section 3.
10. Governing law
These Terms are governed by the laws of Norway. Any dispute arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the Norwegian courts, without prejudice to mandatory consumer protection rights you may have under the law of your country of residence.
11. Changes to terms
We may update these Terms from time to time. For material changes, we will notify you in the App and ask you to accept the updated Terms, and we will update the "Last updated" date on this page.
